These Terms and Conditions ("Terms") govern your access to and use of the buildconnect.com website, including the ordering, purchase, and receipt of materials and services offered by Build Connect Inc. ("Build Connect," "we," or "us").
By accessing or using the Site, placing an order, or receiving materials, you signify that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, you may not access or use the site.
1. Acceptance of Terms and Service Description
Build Connect operates as a direct supplier and seller of building materials for construction projects across the USA. These Terms constitute a binding agreement between you and Build Connect Inc. governing all transactions for the supply of materials.
Eligibility: By using the Site, you represent that you are at least 21 years old and have the legal capacity and authority to enter into this commercial agreement.
2. Ordering and Payment
Order Acceptance: All orders are subject to acceptance by Build Connect. We reserve the right to refuse or cancel an order at any time for reasons including product availability, errors in description or price, or errors in your order.
Pricing: All prices are subject to change without notice. The price charged will be the price in effect at the time the order is accepted.
Payment Terms: Payment terms are specified in your individual quote and/or invoice. Failure to adhere to payment terms may result in delayed delivery or order cancellation.
Taxes: All prices exclude sales, use, excise, or similar taxes. You are responsible for all such taxes, duties, and customs fees.
3. Shipping, Delivery, and Risk of Loss
Delivery: Delivery dates are estimates only. Build Connect shall not be liable for any delays in delivery. Time of delivery is not of the essence.
Risk of Loss: The risk of loss and title for all materials purchased passes to you upon our delivery of the materials to the carrier at the shipping point (FOB Shipping Point).
Inspection: You must inspect materials upon receipt. Claims for shortages, errors, or visible damage in transit must be noted on the carrier’s Bill of Lading (BOL) at the time of delivery and reported to Build Connect immediately.
4. Limited Warranty
Build Connect warrants that the materials delivered will conform to the description in the accepted quote and will be free from defects in material and workmanship for a period of one (1) year from the date of shipment.
Exclusions: This warranty does not cover:
- Damage caused by improper installation, storage, maintenance, or use
- Normal wear and tear
- Defects caused by modifications made by the buyer
Remedy: Your sole and exclusive remedy for breach of this warranty shall be, at Build Connect's option, to repair the defective goods, replace the defective goods, or refund the purchase price of the defective goods.
Disclaimer of Implied Warranties:
EXCEPT FOR THE EXPRESS WARRANTY STATED ABOVE, BUILD CONNECT MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILD CONNECT SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE) ARISING OUT OF OR RELATING TO THE SALE, DELIVERY, INSTALLATION, OR USE OF THE MATERIALS.
Build Connect's total cumulative liability for any and all claims related to the purchase of materials shall not exceed the purchase price paid by you for those specific materials giving rise to the claim.
6. User Account and Intellectual Property
User Account: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Intellectual Property: The Site and its entire contents (text, graphics, logos, software) are owned by Build Connect Inc. or its licensors and are protected by US and international intellectual property laws.
7. Governing Law and Dispute Resolution
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
Any legal suit, action, or proceeding arising out of or related to these Terms or the purchase of materials shall be instituted exclusively in the federal or state courts located in Snohomish County, Washington.
